Dr John Picton represented Charity Law and Policy Unit colleagues in the Scottish Parliament in Edinburgh on Thursday 9 March 2023.

He was a witness at the Social Justice and Social Security Committee, which is working on Scotland's new Charities (Regulation and Administration) (Scotland) Bill.

Also as witnesses at the Scottish Parliament were Martin Tyson (Office of the Scottish Charity Regulator) and John Maton (Charity Commission for England and Wales).

Charity law in Scotland is entirely distinct from the body of rules and cases in England. But the two jurisdictions interrelate and often develop in tandem.

Headline reforms in the Bill involve:

  • listing trustees on the Scottish Register of Charities so as to make them more accountable,
  • the automatic disqualification of senior charity employees guilty of misconduct,
  • and a new requirement that charities registered in Scotland must have a real connection with the jurisdiction.
